  1. The two easiest forms of evidence will be documentary and testimonial. Documentary is the most obvious because you can find communications, photos, etc of the crime in question on the hard drive and they can be presented to the court as documentary evidence. Testimonial evidence could be similar to documentary evidence, but have an expert testify how the evidence was found on the hard drive or how it was used to link it to something else. As for real evidence, unless there was a fingerprint, blood, hair, DNA, etc the hard drive wouldn’t really be able to be used as real evidence. Lastly, demonstrative evidence would be possible if the evidence was on a classified hard drive and they needed to demonstrate to the court how something was done. This is one possibility for demonstrative evidence.
  2. The first thing I would do is read through the investigation files to see what methods the suspect is using to store/transmit the child pornography. This would give me focus on what to look for at the crime scene. When searching the residence I would be on the alert for anything with digital storage. The types of items I would seize would be, but not limited to, mobile phones, laptops, desktop, tablet (Chozik 2019), or anything with a camera that can take photos or video or store digital media.
