Hello all,

When planning to conduct a field operation on possible suspects, what roles do the legal counsel and the agency leadership play in the surveillance and reconnaissance planning?

The role of the legal counsel is to advise the investigators on any possible legal issues within the plan to conduct a surveillance or reconnaissance operation (National Security Agency, 2014). The legal counsel may be implanted within the actual operation (surveillance or reconnaissance operation) to advise the investigators throughout the conduct of it on any law or civil liberties violations that may be about to happen (Central Intelligence Agency, 2019). They can also advise the investigators on courses of action they can take to ensure laws and civil liberties are not violated in a fluid and changing environment (Central Intelligence Agency, 2019).

The role of the agency leadership is to foster an environment that ensures the agents are conducting themselves professionally and always place the importance of following the law and civil liberties of suspects first in the pursuit to gain information to protect national security interests (Central Intelligence Agency, 2019). The agency leadership will approve the plan once it has been reviewed by agency legal counsel to ensure all laws are followed and civil liberties are not being violated (National Security Agency, 2014). The agency leadership has the authority to end any operation that is not following the plan as outlined and that potentially violates laws or civil liberties during the actual operation (NSA / CSS, n.d.).

Do you feel their roles are crucial?

I feel that without the role of legal counsel and the agency leadership many investigators would be hesitant to conduct any form of surveillance or reconnaissance operation due to the very likely possibility of being held personally accountable for any violation of law or civil liberties. Legal counsel conducts the review and “blesses” the plan and then the agency leadership accepts responsibility for the plan (Central Intelligence Agency, 2019). This permits the investigator to follow the plan without any concerns of violating the law or civil liabilities as long as they follow the plan as approved (NSA / CSS, n.d.). The investigator needs this validation in order to conduct their responsibilities in a thorough and consistent manner and not have to worry if they may be brought up on charges or sued in civil court.

The roles of legal counsel is to explain in detail to the courts the 5 W’s and how and it is a cover yourself to have legal counsel. Counsel can advise the legal parameters behind the surveillance and reconnaissance of the operation. counsel can further explain warrants and the legalities behind them, they can explain the legitimacy of searches and protocol. Agency leadership is important because as in any field, we have a chain of command. This further provides accountability, it provides multiple eyes on a task to validate or provide more detail from the extra eyes.

I believe the roles are important because one protects those involved and the other protects the operation as a whole. In my opinion, a situation where multiple legal offices would be utilized could be illegal immigration. I say this because those who immigrated here illegally have to deal with the US system as well as their own respective country and their regulations. Now if the individual is a known gang member, having leadership will provide experience and can easily end up piecing together other criminal cases. Legal counsel would be present to cross the “t” and dot the “I” to ensure that the basic human rights of the resident are not violated.
