1. What ethical standard does Smith advocate for criminal defenders? In other words, what does she think is morally obligatory for defense attorneys to do to defend their clients? Answer in the form of a conditional. The conditional should be in this basic format: “If [ … ] then a defense attorney is morally obligated to do x when defending their client.” Briefly explain and support your answer.
2. Smith gives two types of arguments for the above ethical standard, in section IV.A. and IV.B. Summarize the main idea of the argument in IV.A in one sentence.
3. Smith thinks that it is too personally difficult (that is, difficult for the attorney) for defense attorneys to do their job at all if they do not adopt an “ethics of zeal.” Why? What makes the job so difficult? (1-3 sentences)
4. Why is it important for the lawyer and client to have a trusting relationship? Why, according to Smith, does that require that the lawyer adopt an “ethics of zeal?” (1-3 sentences)
5. To what extent do you agree with Smith? Why (explain and defend your own view)?
